However, there are agents that are prospering in these tough times; agents who seem to have an endless supply of listings. Listings that are priced to sell and don’t require all the paperwork and time that is necessary for a short sale transaction to close. Those agents are the REO agents and if you believe that is the road to success in today’s tough market, then this book is for you. WHAT IS A REO AGENT? A REO agent is a licensed real estate professional who lists properties that are owned by lenders. These properties have taken them back by the lender after a foreclosure auction. These properties held in the lender’s inventory are called “real estate owned” or REO by the lender. Lenders are looking for skilled agents who can list and sell these properties for them. WHY IT IS THE BEST TIME TO BECOME A REO AGENT? REO agents are in most demand in distressed real estate markets when foreclosures are high. Today’s market is not only one of record foreclosures but one of record REO inventories as well. When the market started falling in 2006, this country had just experienced the hottest real estate market in history. Foreclosures and REOs were rare because homeowners in financial trouble could always sell or refinance their properties. The real estate market was so good the REO agent almost became extinct. Since the market changed in 2006, lenders have been scrambling to find experienced REO agents. As the market continues to deteriorate today, their need for more REO agents has never been higher. Thus, now is the best time to become a REO agent. ©2008 VALCO Press 1 WHY DO SOME THINK IT IS HARD TO BECOME A REO AGENT? With the demand from the lenders as great as it is for REO agents today, why is it so difficult to get any REO listings from the lenders? When you apply with lenders to list their REO properties, you are usually required to fill out a detailed application with many questions regarding your REO experience. If you don’t have REO experience, the lenders are reluctant to hire you to list their properties. The quandary becomes how will you get the experience they require if they won’t hire you because you don’t have the experience? One thing you can do is apply to become an agent for an existing REO brokerage. Then you can get experience by working for an experienced REO broker. However, even assuming you can find an opening with a REO broker who agrees to take you under his or her wing and mentor you in the REO business, the REO broker will require you to sign a non-compete agreement. A noncompete agreement may later limit your chances of success in this business because you will not be able to work for the lenders with whom you have established relationships while you were working for the REO broker. However, at least you will have gained experience for your resume if you apply with different lenders. A second thing you can do is join one of the REO broker associations or organizations to establish connections with some lenders or even possibly getting referrals from the organization. However, the biggest REO organizations, REOMAC and NRBA, have frozen their new memberships. They are no longer accepting new members and now have waiting lists with thousands of agents already on them. They have done this because too many members reduce the amount of business for each of their members in each geographic area. It seems that REO brokerage is an exclusive club and which is very difficult to join. New REO organizations are starting to appear so it could be beneficial to join one of these new groups. At the very least, it gives you something to include on your resume that is REO related. ©2008 VALCO Press 2 WHAT IS THE BEST WAY TO BECOME A REO BROKER? Because of today’s REO crisis, REO outsourcers are in dire need more agents. Outsourcers are independent companies that contract with lenders to provide REO services for them from start to finish. They have set up networks of agents around the country that they can refer REO listings to when the assignments come in from lenders’ asset managers. Because of the rate that REO inventories are increasing, the outsourcers currently need more agents to list the properties that are being referred to them. Although the outsourcers are also looking for agents with REO experience, many times it is easier to get your foot in the door with them than it is with lenders directly. ©2008 VALCO Press 3 IS THERE ANYTHING I SHOULD KNOW ABOUT THE RESPONSIBILITIES OF REO AGENTS? Listing REOs is a lot different than listing properties for sellers who occupy the property or own it as an investment. The REO business can be hard work and time consuming compared to the “normal” listings you are used to. But the trade off for the extra work you will be doing will usually be more than made up by the volume of listings you will receive. As a REO agent, you should expect to sign special lender listing agreements. Lenders will require you to sign their own listing agreements; not the listing forms your local board has created for your use. The lender listing agreements will spell out the additional duties you will have to perform for the lender if you agree to list the property. Sometimes these extra duties are contained within the listing documents and other times they may come in the form of an Agent Responsibility Agreement. Some of the additional responsibilities an REO agent is expected to perform are as follows: • • • • • • • • • Conducting regular drive by inspections of the property prior to the foreclosure auction; Performing pre-foreclosure BPOs; Helping secure possession of the property from the prior owners, usually by contacting the former owners and opening a line of communication with them; Conducting an initial inspection after the foreclosure auction and obtaining bids for all necessary repairs; Assisting the lender client in deciding whether to sell the property “as is” or completing one or more necessary repairs if it makes economic sense; Conducting inspections and performing BPOs for the lender during your listing on a regular basis that could be from weekly to monthly; Acting as a general contractor by coordinating the completion of the repairs to the property; Paying for all utility expenses and repairs up front out of your own pocket and then being reimbursed by the lender between 30-60 days afterward; and Regularly updating the lender on the status of your listing, including advertising efforts, showings and activity from other agents. This is usually done by directly inputting information into their system over the Internet. ©2008 VALCO Press 4 ARE THERE DRAWBACKS TO BECOMING A REO AGENT? As you can tell from the answer to the question above, being a REO agent generally requires extra effort and work, compared to your standard listing. If you don’t perform these additional services required by the lender, your listing will be terminated. Further, with regard to the extra work you will be expected to perform, you will not receive any extra compensation for these services. In fact, the majority practice of lenders is to only pay a five percent commission to their listing agents from which the listing agent is only permitted to receive two percent with the remaining three percent paid to the selling agent. Also, if you received the REO listing as a referral from an outsourcer and not directly from a lender, you will be expected to pay a referral fee to the outsourcer. This referral fee is usually 25 percent of your part of the commission. This means that you may only earn 1½% for listing a REO. Finally, because you will be required to pay for utilities and repairs out of your own pocket up front and then bill the lender for reimbursement, you will need to have access to sufficient cash (even if it is from credit cards) to pay these expenses as they accrue. The amount of cash you will need to have on hand will depend on how many listings you will be getting from the lender on a consistent basis. A couple of listings a month may only require a reserve of $15,000$25,000. Six listings a month and up may require $50,000 or more in available cash or credit. It is important to realize that if you are receiving a relatively steady flow of listings that you will always be floating this money. ©2008 VALCO Press 5 WHAT ARE THE BENEFITS OF BECOMING A REO AGENT? With all the hard work required and reduced commissions, why would an agent want REO listings? Because the potential financial rewards and other advantages outweigh the disadvantages. 1. Consistent Listings. Once you start getting listings from an asset manager and they are confident you are competent, you will start receiving listings on a consistent basis. A single asset manager for a lender could refer you anywhere from several to hundreds of listings a year. 2. High Volume. As your REO business expands and you start receiving listings from other asset managers, you will soon find the volume of REO referrals increasing very quickly. This is especially true in a foreclosure market like today. With a regular large volume of listings, you will always have properties closing. 3. Listings that Sell. Lenders need to dispose of their REO properties. They must sell them as quickly as possible for both financial and regulatory reasons. Unlike regular sellers, they can keep dropping the price until the property sells. 4. Substantial Income. When you have a consistently high volume of listings that you are selling, that obviously means you can earn a very good living in the REO business. 5. Flourish in a Down Market. In a good up market, most agents can be successful with very little effort. But when the market turns bad, most of those agents end up leaving the business and most of the few that remain only scrape by. The small number of agents that know how to work in a down market, who specialize in foreclosures, short sales or list REO properties, will not only survive, but actually flourish when times are tough. A down market like we have today is a REO agent’s dream. ©2008 VALCO Press 6 IS THERE ANYTHING I SHOULD DO BEFORE I START APPLYING TO BECOME A REO AGENT? Definitely! When you start contacting lenders, outsourcers and asset managers, you usually only get one chance to convince them you’re right for the job. Your first impression is critical. A major key to your initial success is understanding what the lenders and outsourcers are looking for in a REO agent. What they are looking for first and foremost is experience. If you’re not already in the REO business, how do you get around this “experience” requirement? Sometimes you can’t, but sometimes, if you can present yourself in the right way, you can make it onto the lenders’ and outsourcers’ approved agent lists. So how can you present yourself to lenders in a way to minimize the impact of your lack of experience? You have to first create a lender-friendly resume. Having this resume prepared in advance will make sure that you will have all your ducks in a row when you start applying for REO work. Since you may not have any actual REO experience or lender references to put on your resume, you will need to come as close as you can. Here are some items to include in your resume to make the resume more lender-friendly: 1. Lender Related Experience and References. If you’ve done BPOs, list your experience and get references if possible. If not, start signing up for BPO work immediately. Doing BPOs for a lender is as close as you can come to actual REO experience. List any lending or mortgage brokerage licenses or experience you have. Contact all the lenders you’ve sent loans to in the past and ask for letters of reference on the lender’s letterhead emphasizing what an excellent REO agent you would make. 2. REO Work-Related Experience. Remember, a REO agent is also a rehabber and a property manager, in addition to being a real estate agent. So if you have ever been a property manager, rehabbed properties or acted as a contractor, make sure this type of experience is included in the resume. 3. Education. Emphasize any special education or training that you have. Courses on foreclosure, REO brokerage, performing BPOs, appraisal, rehabbing and property repair, property management and contracting will demonstrate you have education, training and skills in areas that REO agents must know. ©2008 VALCO Press 7 4. A REO Team in Place. Successful REO agents are not loners. They have a staff to assist them and an outside team of specialists ready to go on a moment’s notice to take care of properties. Emphasize to the lender you have a staff assisting you (even if you share them with other agents or your entire brokerage). They could even be virtual assistants on the Internet Some staff positions could include a transaction coordinator, marketer, licensed assistant, and a field assistant to help monitor properties and repairs. Your outside team should be assembled and cover all areas of property maintenance and repair. Members of this team could include a general contractor and subcontractors, such as a plumber, electrician, handy-man, clean up crew, painter, roofer and landscaper. 5. REO Related Memberships. Join REO organizations. Some have closed their memberships or have long waiting lists. Fortunately, in today’s foreclosure environment, new REO organizations are being formed all the time. Join them and put them on your resume. If they can provide you with any certifications or designations, all the better. 6. Personal Qualifications. If you have any special qualifications that you think might help you get the business, make sure to include them as well. Some examples are foreign language fluency or market expertise in specific geographic areas, from one or more counties to specific zip codes. Sometimes, lenders assign files by zip codes and they have trouble finding agents in remote or out of the way areas. List any skill that makes you unique and that a lender may find a plus for even one REO property in your area. ©2008 VALCO Press 8 IS THERE ANYTHING ELSE I CAN DO THAT MIGHT HELP ME GET REO LISTINGS? Outside of direct contact with lenders and outsourcers by applying with them, there are a few ways to break into the business by luck and circumstances. The best way to try to make this happen is by placing yourself in front of those people and companies who might be able to help you get in the business. This means you need to do two things: 1. Exploit All Lender Related Contacts You Make. During the day-to-day course of your real estate business, you have come across and will come across many individuals who could be the one to help you get into the REO business. You never know which one has that name or number you need. So every time you have a favorable contact with someone connected to a lender, remember to just ask them if they know anyone or any way that can help you become an approved REO agent for their lender. Sometimes they know who to contact or even may have once worked in the REO department themselves. So every time you meet a loss mitigator, loan officer, foreclosure trustee or field services company representative, ask if they know anyone you can contact or any other way to get in contact with their lender’s REO department. 2. Attend Industry Events and Network. The major REO broker associations and industry default servicing organizations hold annual or semi-annual conferences and educational events for their members and the REO industry in general. These regional and nationwide events are attended by servicers, lenders, asset managers, REO outsourcers and other REO industry insiders. Many REO brokers got their start in the REO business just by meeting the right people and making the right contacts at these events. Look for one of these events near you, sign up and attend.
