There is no fee payable on this application as it is the second application for the site
within the same year made by the same client.
Pfease note your letter dated the 23 February 2004 to our client confirming the
acceptance and discharge of condition 2,3,5,7 ,11,and 14.
Condition 7 - reference the windows where you asked my client that there should not
be any arched heads on the window. The windows installed have got no arched heads
and therefore they are approved.
I can also confirm that my client has gone out of his way to emulate the local
architecture in every part of the site and he has laid rnore dry stonewalling than
necessary at a great cost. There is nowhere on this site as he tried to cut corners for
cost reason or erect something which is not Cotswold in character.
Once you have had a look at the enclosed application please would you contact me

Dear Mr Field,
We refer to the above Planning Permission and Mr J Graville's visit on the 22nd June
responding to local complaints.
Belorv is a list of points, some of which answer points already raised by Mr Graville and
others; the rest clarify slight alterations that rve believe should be raised and resolved in
view of the local "interest".
We rvould like to point out at this stage that we have tried tremendously hard to create a
building that "fits in" to the local environment. The stone is sourced locally, and is used
throughout the village for both walls and houses, and of course has had approval.
Additionally at great expense, we are using narrow courses of stone c. 2" - 5"
which is a village feature, and of course, using traditional "mixes" with lime, coarse sand
and cement, which also has approval after various trials. We have had numerous
compliments on the general appearance especially the stonervork and the dry-stone walls.
Listed belorv are the items of concern:-

Garaee Width:
When Mr Graville came, this was the frrst time we realised this was out of "approval"
when he measured it one metre too wide.
Unfortunately when the Oversite Contractor came to do the foundations it was deemed
necessary by the architects to build a "concrete, reinforced-raft" for the base. The new
drawing that came from the Engineer / Architect was based on a raft that was one meffe
bigger! Subsequently the Stone Mason built the garage to the same drawing, and of
course we took the ffuss measurements from the same drawing and the discrepancy
throughout never raised its head until the visit.
We apologise for the error but, due to the drarving changes, rve hope you can understand
how this came about. As instructed, we enclose a revised planning application for this
unfortunate error.

All
the above are recessed by c.5cm not the 7cm as in the conditions. On?h*hin. we
didn't notice this mistake, although we knew of the condition of recessed apertures @
7cm.
The Stone Mason in charge, of over forty years experience, set these items at this depth
as was normal in his experience. We certainly didn't notice this departure from the
conditions, as indeed the Architect didn't.
We severely hope this additional error can be allowed as the overall appearance, we
suggest, is unnoticeable to the majority of people.
3.
Windows
We believe that the windows installed are certainly the ones we had approved and
ordered. Dralvings were requested from the suppliers and were sent to C.D.C, together
with a Photostat of P21 of the Sovereign Stormsure Catalogue, and a photo of another
house in the village that has them installed. You can see from these details that we were
trying to be correct in our approach and we even had a letter on the 23'o February saying
"the details of the joinery are acceptable provided the windor,vs do not have arched
heads". Naturally we ensured no "arched heads".
Might we suggest that your decision regarding the above is held "in obeyance" till the
work has been totally completed. Hopefully the general appearance, in total, might be
"approvable" rather than looking at a building-site. The reason being is that the windows
are already installed (as we believed approval was agreed) and we can meet your
suggestions after, when the building is totally completed.
Enclosed is the revised Planning Application, but whilst writing we would like to ask for
a "Retention of Existing Works" together with the following amendment:-
a)
Three windows have been re-allocated to improve light in our hall-way (please
see enclosed drawing). It also means less window area facing our neighbours at
Hathaway House but more over the uninhabited allotments.
b)
Oil Tank - this has been re-allocated, so as not to move our neighbours tank hence a boundary movement, which is being altered in the deeds (drawing
enclosed)
c)
Eaves detail

these match the adjoining property for correctness.

These pillars as per enclosed drawing - built with
The size is c.0.40m higher than existing wall and c.0.l5m wider on
per the existing wall. We suggest that the pillars could not be flush with the
existing wall for appearances sake. These pillars are to hang inward facing gates
of 0.36 metres.
e)
Instead of a "portico" we hope to add a Porch with the "Class D" criteria of
3.0 sq m , in the approved materials - we believe this does not need planning
approval.

My wife wishes to change the outside paint colour from Crown Palladium 4, but
has not yet decided to what. May we please revise the colour when she decides,
with your approval later?

The parish council objece on the grounds that Cold Aston is in a conservation area and
an AONB. Thcrefore CDC has strict rules and regulations to be applied to building works
in the area and these are detined in its own publications including ttre 'CoBwold Dcsigtt
Code'. 'The setting of any building should be carefully considered whether in the
countryside or in a built up area. Attention should be paid to its impact on public views
into, over and out of the site'. In this case' the view of the church from the approach to
the village along the Notgrove Road has been obliterated and *re building iself has not
been'located to sit comfortably in the landscape'.
With regard to enforcement, CDC, in its information about planning decisions, states that
the applicant 'must follow the agreed plans carefully and comply with the conditions'.
the applicant fails to curnply with dre decision notice he oould be in contravention of the
Town and Country Planning Act 1990. 'In such circumstances, the council may well
initiate enforcem€nt action'.
The applicant, Mr Seddon, has broken these conditions in seneral matters, namely:
The windows are not reccssed to the minimum required
7. The ftont door is not recessed to the minimum required
3. The garage is I m wider than applied for and the roof line is consequently altered,
leading to an overly prominent and unsightly building
4. There:re no chimneys
5. The entrance gat€ pillan did not have planning permission as required and are out
of proportion with the conage. As per the Design Code 'boundary treatmens play
an important role in settJing a ne'w building into an existing street scene'
The Council would like CDC b ensure that t}e choice of paint colour is resolved betbre

the windows are painted, bearing in mind that the Counoil's preferred colours are
Buttermilk (BSI0C31), Hopsack (BSl0Bl?), Willow (Bsl2tsl7) or Flake Grey
(BSroA03)
Finally, the Council would like CIDC to bear in mind that Cold Aston is a small,
vernacular village with a srong Coewold feel that we do not wish to see eroded by poor
planning decisions. As CDC's own Design Code states 'CDC is determined to raise the
standards of tayout and design of new development Planning decisions taken now will
result in development that will last well into the funrre. Future genentions will judge us
by the quality of what we build. The quality of design in new development is perhaps the
most obvious measure by which most people judge the planning systern'. The Council
therefore urges CDC to enforce in own regulations and Design Code in the case of this
property and to therelore reject this new application.
