On behalf of the Board of Bicycle Indiana and the
Executive Committee, I am pleased to introduce the
2016 Bicycle Indiana Resource Guide. This year’s
Resource Guide is being released later than usual
– for that we apologize. We hope that you find it to
be a useful resource for finding all the information
you need, whether that is rides or retailers within
the State of Indiana. We encourage you to support
those rides, and especially the funding rides. These
funding rides support Bicycle Indiana and allow us
to continue our programs, including this Resource
Guide. We also want to take the opportunity to
thank all of ride organizers and advertisers. We
appreciate your continued support, we look forward
to working with you in the future and we hope that
all of your events are successful this year. It is
never too early to start planning for the 2017 Resource Guide; the earlier we can
compile all the information on rides, resources and advertisement, the earlier we can
release the Resource Guide.
How will you help improve these statistics for next year, and how will you help
celebrate Indiana’s bike-centennial?
Lastly, remember that Bicycle Indiana is a membership-based organization.
We want to hear from our members. We want to hear about the issues that are
important to you and we need your help to shape the future of Bicycle Indiana.
This year when our State Legislature reconvenes, Bicycle Indiana will again be
working to pass statewide legislation. At this time, we do not know if that is a Three
Foot Passing law or a Vulnerable Road User law. We do know there is strength in
numbers and that collaboration among all of the bicycle organizations, clubs and
retailers, and partnering with the other organizations, clubs and groups involved in
active transportation and walking is the key to our greater success. If legislation is
important to you, we encourage you to talk with your local legislators, and also invite
them to a local ride. Show them that we all belong on the roadway and can Share
the Road! If you would like to share your thoughts and ideas, please email me at

Prejudices in Bicycle Cases and the Need for Etiquette on the Road

The problem with bicycle crashes is that we usually don’t see them coming until it’s too late. When family members
or friends can’t offer adequate advice after a collision, people often turn to attorneys. Unfortunately, we’ve seen the
results of too many collisions caused by the negligence of others. In the interest of helping to reduce the number of
tragedies in Indiana, below are some key facts and a perspective that may be beneficial to cyclists and motorists
down the road.
Two of the biggest issues we face as a community when bicyclists and autos share the road are a basic
understanding of bicycle laws and a willingness to take responsibility for our actions as cyclists and drivers. In 2014,
Brian Eason wrote a piece for the IndyStar titled “Clash of cultures: Motorists, cyclists face uphill climb.” “Policy
clashes, he wrote, suggest that Indiana’s newfound love affair with cycling has come to an uneasy crossroads, facing
off with at least three trademarks of Hoosier culture and values: our reverence for individual property rights, our
frugality and our passion for the automobile.”
70% of cycling activity occurs on roadways shared by automobiles and trucks. Given that percentage, chances are
we’re going to see a lot of questionable behavior by motorists, and cyclists alike. Whether you are a driver, cyclist or
pedestrian, you can help prevent accidents by being aware of your surroundings and respecting those around you.
The greatest threat to cyclists is the negligent driver. This goes beyond texting while driving. Negligent driving
may involve speeding, tailgating, overtaking, failure to yield, distracted driving, misuse of a bicycle lane or failure to
leave a 3-foot buffer. When negligent driving causes an injury or death, at-fault parties may be liable to the victim in
civil damages. Moreover, the cyclist injured may be entitled to compensation for hospital bills, lost wages, pain and
suffering, and property damage.
How can you help? Be aware. Share the road. Share the word. For example, did you know the most common types of
crashes in Indiana occur so frequently they have names like the right hook and the drive out?
Most Common Types of Crashes involving Bicycles:
1. The Right Hook – A right hook bicycle collision occurs when a driver passes a cyclist on the left and proceeds to
make a right-hand turn directly in front of the cyclist’s right-of-way.
2. The Left Cross – Left cross bike accidents take place when a motorist makes a left turn directly in front of the
biker’s pathway. In Indiana, these often occur at cross-walks and intersections with heavy bike, pedestrian, and motor
vehicle traffic, like downtown Indianapolis and other heavily populated areas in Indiana.
3. The Drive-Out - A drive-out bicycle accident happens when a driver pulls out directly into the cyclist’s right-of-way.
4. The Rear-End - Rear-end collisions occur most frequently in areas of heavy, stop and go traffic when the motorist
operates his or her vehicle into the back of a cyclist.
5. The Overtake - Overtake bicycle crashes take place primarily when a motorist attempts to pass a cyclist on the
open road. Many cities in Indiana have adopted the “3 foot rule,” requiring motorists to leave at least 3 feet of space
when attempting to pass a cyclist.
6. The Dooring - Dooring bicycle crashes occur when a driver opens the door of his or her parked vehicle directly into
the pathway of an oncoming cyclist, causing the cyclist to collide with the door, often at a high rate of speed. They
frequently cause the cyclist to flip over the door, leaving him or her vulnerable and exposed to oncoming traffic.
7. The Careless Cyclist or Pedestrian - Cyclists and pedestrians who carelessly enter a fellow bicyclist or pedestrian’s
pathway can be liable for the resulting injuries.

Prejudices in Bicycle Cases

We understand that a segment of the public is prejudiced against bicycle riders.
Some of the most common biases against riders include:
1. Bicyclists are not careful and dart in and out of traffic.
2. Bicyclists disregard traffic signals when riding.
3. Slow riding by cyclists slows traffic and creates unnecessary back-ups in traffic.
4. Bicyclists are risk-takers; inattentive to traffic conditions around them.
5. Cyclists injuries are due to their failure to wear protective gear and to illuminate
their bicycles and themselves.
These preconceptions must be addressed early on in any personal injury case.
Consider the types of questions we address when trying a case:
1. Who has the right of way? Does it apply to everyone in that lane and are there
ever exceptions? This will affect the outcome of a case and whether or not a
cyclist is properly compensated for their injuries.
2. Is getting hit simply a risk bicyclists take? If so, does this risk relieve the
defendant of responsibility for violating the rules of the road?

3. Could the collision have been avoided if the driver had watched where he was going and let those with the right-ofway pass? When is defensive driving possible and when is it not?
After an accident, who needs representation?
The question we hear most often is “How would legal representation benefit me?”
Financial need - When serious injury or death results from an accident, no matter the cause of the accident, lives
are impacted and rarely return to what they were before the accident. We’ve seen people go through various stages
after a life-altering accident, including emotional damage and financial losses. Importance is, and should be, placed
on physical and emotional recovery; but, financial stress often builds throughout the recovery process. Over time,
medical bills accumulate and the loss of income has a lasting effect. In the end, someone else’s mistake can ruin your
financial future.
The truth about insurance claims - Unfortunately, the majority of individuals and family members affected by an
accident are unfamiliar with their rights under Indiana law. To make matters worse, when faced with a claim against
one of its insured, insurance companies hire lawyers to represent the insured not the victim. While Indiana law
protects victims of negligence, personal injury and wrongful death claims are further complicated when multiple
individuals are injured and proceeds are limited.
Time limits – There is also a legislative time limit on your option to file a lawsuit. In any catastrophic injury, it’s
important to speak with an attorney as soon as possible to ensure that your legal right to file a claim doesn’t expire.
Securing prompt legal representation can help to ensure your attorney has ample opportunity to gather all relevant
evidence.
Who is at Fault? Establishing Liability in Bicycle Accidents
A victim who suffers a catastrophic injury or a loved one’s wrongful death claim must assert that someone other than
themselves was at fault for the accident. Many factors must be evaluated to establish liability, which is why it’s so
important to have safety and accountability rules and requirements in place. Fortunately, we have organizations like
Bicycle Indiana to promote, educate and advocate for bicyclists.
Bicycling is not inherently dangerous; however, when bicycles and motor vehicles are using the same roadways, the
chance of incidents occurring increases. By educating all Hoosiers on bicycle laws and safety, together we can reduce
the number of cyclists injured in crashes.

As with all outdoor activities you
need to take some action when
bicycling to prevent injuries and
to make the activity more enjoyable. Here are some safety tips
for bicycling.
1. Always Wear Your Helmet
– Be sure it covers your
forehead and fits properly.
Helmets are for all ages
– set a good example to
others by wearing your
bicycle helmet every time
you ride.
2. Ride on the Right – Always
ride with traffic.
3. Obey All Traffic Laws – Stop
at stop signs and stop lights
and obey one-way streets.
4. Signal and Look before
turning.
5. Ride in a Predictable
Manner – Ride in a straight
line. Don’t swerve between
parked cars.
6. Use Head and Tail Lights at
Night – Reflectors are not
enough.
7. Keep Your Bike in Good
Repair – Have it tuned
up by a professional bike
mechanic regularly.
8. Yield to Pedestrians
– Pedestrians have the right
of way.

9. Ride Defensively. Follow
the rules of the road. In
Indiana, the bicycle is a
vehicle and has all the
rights and responsibilities
of other vehicles. This
means stopping at stop
signs and stoplights,
riding on the right side of
the road, and signaling
for turns.
10. Drink before you’re
thirsty, eat before you’re
hungry. Take along
plenty of water. Use
sports drinks for longer
rides. Snacks to take
along include cereal
bars, cookies, fig bars,
and fruit (bananas,
apples are best).
11. Items You Should Carry:
Identification, money
(for ice cream or other
goodies along the ride),
tools, spare inner tube,
bicycle pump. There are
many different bags that
you can attach to your
bike that could carry
what you’ll need for the
day.
12. Plan a ride less than 10
miles when riding with
small children, those who
have not bicycled very
much or if the terrain is
challenging. Plan stops
along the route or have a
destination in mind.

9-21-11-1 Children and wards;
bicycles; violations
Sec. 1 (a) The parent of a child
and the guardian of a protected
person may not authorize or
knowingly permit the child or
protected person to violate this
chapter.
(b) Subject to the exceptions
stated, the provisions of this
chapter applicable to bicycles
apply whenever a bicycle is
operated upon a highway or path
set aside for the exclusive use of
bicycles.
9-21-11-2 Riding on roadways;
rights and duties
Sec. 2 A person riding a bicycle
upon a roadway has all the rights
and duties under this article that
are applicable to a person who
drives a vehicle.
Except the following:
(1) Special regulations of this
article
(2) Those provisions of this
article that by their nature have
no application.
9-21-11-3 Seats
Sec. 3 (a) A person propelling a
bicycle may not:
(1) Ride other than upon the
permanent and regular seat
attached to the bicycle; or
(2) Carry any other person upon
the bicycle who is not seated
upon a firmly attached and
regular seat on the bicycle.
(b) a person may not ride upon a
bicycle unless seated under this
section.
9-21-11-4 Passengers
Sec. 4 A bicycle may not be
used to carry more persons at
one (1) time than the number
for which the bicycle is designed
and equipped.
9-12-11-5 Hitching Rides on
Motor vehicles or street cars
Sec. 5 A person upon a bicycle,
a coaster, roller skates, or a toy
vehicle may not attach the bicycle,
coaster, roller skatesor toy vehicle
or the person to a street car or
vehicle upon a roadway.
9-21-11-6 Riding two abreast
Sec. 6 A person riding a bicycle
upon a roadway may not ride
more than two (2) abreast
except on paths or parts of
roadways set aside for the
exclusive use of bicycles.
9-21-11-7 Carrying articles
Sec. 7 A person who rides a
bicycle may not carry a package,
a bundle or an article that prevents
the person from keeping both
hands upon the handlebars.
9-21-11-8 Bells or other
audible signal devices
Sec. 8 A person may not ride
a bicycle unless the bicycle is
equipped with a bell or other
device capable of giving a signal
audible for a distance of at least
one hundred (100) feet. A bicycle
may not be equipped with and
a person may not use upon a
bicycle a siren or whistle.
9-21-11-9 Lamps and reflectors
Sec. 9 A bicycle operated on a
highway from one-half (1/2) hour
after sunset until one-half (1/2)
hour before sunrise must be
equipped with the following:
(1) A lamp on the front exhibiting
a white light visible from a
distance of at least five hundred
(500) feet to the front.
(2) A lamp on the rear exhibiting
a red light visible from a distance
of five hundred (500) feet to the
rear or a red reflector visible
from a distance of five hundred
(500) feet to the rear.
9-21-11-10 Brakes
Sec. 10 A bicycle must be
equipped with a brake that will
enable the person who operates
the bicycle to make the braked
wheels skid on dry, level, clean
pavement.
9-21-11-11 Traffic regulation
and requirements
Sec. 11 A person who operates
a bicycle upon a highway shall
observe the regulations and
requirements of this article.
9-21-11-14 Violations
Sec. 14 A person who violates
this chapter commits a Class C
infraction.

Sec. 3 (a) A local authority, with
respect to private roads and
highways under the authority’s
jurisdiction, in accordance with
section 2 of this chapter, and
within the reasonable exercise

IC 9-21-3-7 Traffic Control
Signals
Sec. 3 (d)If the operator of a
motorcycle, motorized bicycle,
motor scooter, or bicycle
approaches an intersection
that is controlled by a traffic
control signal, the operator may
proceed through the intersection
on a steady red signal only if the
operator:
(i) comes to a complete stop at
the intersection for at least one
hundred twenty (120) seconds;
and
(ii) exercises due caution as
provided by law, otherwise treats
the traffic control signal as a stop
sign, and determines that it is
safe to proceed.
IC 9-21-8-37 Pedestrians and
children; due care; caution
Sec. 37. Notwithstanding other
provisions of this article or local
ordinance, a person who drives
a vehicle shall do the following:
(1) Exercise due care to avoid
colliding with a pedestrian or
a person propelling a human
powered vehicle, giving an
audible signal when necessary
(2) Exercise proper caution upon
observing a child or an obviously
confused, incapacitated, or intoxicated person.
IC 9-13-2-14 Bicycle
Sec. 14 “Bicycle” means any footpropelled vehicle, irrespective of
the number of wheels in contact
