St. Joe moved its offices from Jacksonville to WaterSound in the Florida Panhandle in 2010, but the alleged violations occurred when the real estate developer was still headquartered in Jacksonville. The company disclosed the possible violations in an SEC filing late Monday, saying it received a notice from the SEC staff Jan. 20. The filing said the possible violations relate to “historical accounting and disclosure practices and real estate asset valuations principally as reflected in the company’s financial results for 2010, 2009 and prior periods.” The company in January 2011 disclosed the initiation of the investigation by the SEC. In February of that year, CEO Britt Greene and other top St. Joe executives resigned under pressure from the com- Greene pany’s largest shareholder, Bruce Berkowitz of Fairholme Capital Management. St. Joe said Monday the alleged violations are not directed at any current directors or officers or “any of its controlling shareholders.” The company said the letter is not a formal allegation of wrongdoing, but it gives the company an opportunity to respond to the issues raised by the SEC staff before further action is taken. “At this time the company is unable to predict the outcome of the investigation, any potential enforcement actions or any other impact on the company that may arise as a result of such investiga- tion,” Monday’s filing said. St. Joe last year sold off its 4,057-acre RiverTown community in northern St. Johns County, the company’s last remaining tie to Northeast Florida. But instead of going home, the chatty group tumbled into the clubhouse, backpacks trailing. They formed a line at the Keurig, where each made a cup of hot cocoa. It was a few weeks before Christmas and they eyed a snack tray nearby filled with heart-shaped candy canes. In just a few hours, the work crowd would follow. Some of them would hit Seagrass’s 24-hour gym, with its dozen cardio machines, complete lineup of isometric equipment and full set of free weights. It’s a facility that has become the Public social focus of the community, said Crystal Carswell, Seagrass property manager. “You can replace your regular gym membership with this,” she said. Master-planned communities have wowed their home-seeking audiences over the past decade with country-club size community centers and theme-park style amenities. Now Jacksonville’s top apartments are following suit, with features more commonly seen at a luxury vacation hotel than in a rental complex. The standard fare of a pool, green area and sometimes a workout room is being eclipsed by fully equipped gyms, Vegasstyle pools, dog parks, piano bars, movie rooms, pet-washing stations, basketball courts and outdoor kitchens. legal notices begin on page A-10 Smaller apartments, larger gathering spaces It’s a trend that began in Europe, spread to America and has hit Jacksonville in the past two or three years, said Brian Moulder, CBRE senior vice president for multifamily. “Everybody that’s building an apartment now — the next guy wants to outdo the last guy,” he said. There’s also been a massive shift toward smaller rental units, as the emphasis turns to the amenities. Talks with mayors, pleas with City Council members and a ballot initiative that would have created a library taxing district all failed. There might be a boost around the corner, though. Maybe as much as $600,000. Legislation to be introduced at tonight’s council meeting would create a Library Fines Revenue Fund that would allow the system to keep money it collects on overdue items. The fund would be dedicated for capital projects or maintenance, but not operations. Currently, all collections go back to the city into the general fund — something many didn’t realize. “The community as a whole thought fines and fees went toward the library,” said Erin Vance Skinner, the library’s board chair. A plan initiated several years ago resulted in the recommendation of a “Library for the Future” fund that accrued fines and fees for capital plans. Last year, during the Task Force of Consolidation meetings, the idea again was pitched. The current legislation is a result of the task force. The past five years have seen a decline in all collected fines and fees, mainly due to electronic media becoming more available. In 2010, $1.6 million was collected, trending down to $931,000 last year. That includes collections on overdue items, printing fees when coming from a library computer, non-resident library card fees and lost materials replacements. A breakout of how much has been collected just from overdue materials wasn’t available, but Skinner said it should result in about $600,000. Library.. PwC expects to move about July 1 from the 42-story Bank of America Tower at 50 N. Laura St. to the 23-story SunTrust Tower at 76 S. Laura St. Rick Moyer, managing partner of PwC’s Jacksonville office, said a lot of the decision was based on the firm’s growth the past couple of years. “The SunTrust Building had a very kind of blank-slate floor for us that we could customize,” he said. The design that includes a “millennial focus” allows workers to check in and use office or desk space as needed as well as open space “where teams can work across the organizational business lines.” PwC will move from half of the 30th floor in the Bank of America Tower to the entire 21st floor of the SunTrust Tower. PwC’s build-out creates a construction investment of at least $900,000, according to a pending building permit. Moyer declined to estimate the total cost. The firm has more than 100 employees, he said. He did not provide a specific number of jobs that might be added, but “we are going to hire as many talented people as we can find.” Moyer said the firm looked at 10 to 15 locations around the city before choosing SunTrust Tower. “It is a fastgrowing city and a lot of major companies are putting their h e a d q u a r t e r s Moyer here,” Moyer said. Because of that, “the firm is investing heavily” to serve them. Moyer said décor would focus on the firm’s history, dating back to the 1800s, and the city’s history, including photos and pictures of the riverfront, Downtown, the beaches and prominent figures “that made Jacksonville the city it is today.” PwC has leased space at the Bank of America Tower since 1992. It will move from that 12,555-square-foot space into 13,343 square feet, according to PwC. SunTrust Tower also is gaining Cushman & Wakefield as the exclusive leasing agent. The company will serve as the agent for Parador Partners LLC, which owns about 280,000 square feet of the 383,239-square-foot SunTrust Tower. Cushman & Wakefield Senior Director Traci Jenks is the exclusive leasing representative. The listing was signed last week. SunTrust Tower, built in 1989, had been marketed as officecondominiums by Florida investor Cameron Kuhn, who bought the structure in 2005. After the lender took title to the property in 2008, the office space that remained unsold was made available for lease. Parador Partners bought the space in 2009. Parador Part- Jenks ners now is repositioning the tower by adding a 600-space parking garage, which should be completed by May. Jenks said Accretive Solutions also has signed as a tenant, taking 2,600 square feet. Existing tenant Morgan & Morgan expanded by 9,000 square feet and Elite Parking added 1,000 square feet. “The positive momentum in the building and the garage coming online is a huge enhancement Downtown,” Parador President Ashish Bahl said in a news release. He said the garage will provide more parking options for the building’s tenants and visitors as well as for the Jacksonville Landing, which is across the street. Jenks said the SunTrust Building offers space from 1,500 to 160,000 square feet, which would comprise several full floors. She suggests the fund could be used for repurposing portions of libraries to better serve the community. For example, she said that could mean creating a teen or children’s center in a library that’s determined to have such a need. The fund won’t be used for maintenance or supplement operational dollars — a step done on purpose. If the money was used for operational dollars, the fear is future mayors and councils could simply rely on the account as a funding source to replace parts of annual budget. With a separate account dedicated solely to capital functions, that’s less likely, she said. That’s still a concern for council member John Crescimbeni, an ardent library supporter. He called the trust fund a “great idea,” saying he never understood why the organization couldn’t keep the fines it collected. City Council members will have a pension deal back before them tonight, launching the next round of possible changes. Or in the coming weeks, maybe even a conclusion to the first stage of pension reform. Along with the deal comes a legal opinion from a pension expert on one of the biggest complaints council members have had with the deal. In the opinion of Jim Linn of Lewis Longman & Walker, the city and council could agree to waive the ability to impose benefits during impasses for a speci- fied period of time. That’s been a key point in pension talks, as council sought to have any agreement limited to three years in accordance with state law. The Police and Fire Pension Fund board balked at that, voting instead to revert it back to the 10-year pact Mayor Alvin Brown and fund administrator John Keane signed off on over the summer. The fund also made changes to council-approved tweaks to return rates within cost-of-living adjustments and the Deferred Retirement Option Plan. And while council has pension reform back on its plate, it doesn’t necessarily mean it will be done anytime soon, said council mem- ber Bill Bishop. “I don’t think anything is going to happen before the next election,” Bishop said Monday, shortly after taking part in a pension forum hosted by the Meninak Club of Jacksonville. The is March 24 first election, followed by a general election May 19. Bishop said the issue has too “many moving parts,” such as how to pay the estimated $400 million tab that comes with paying down the plan’s unfunded liability. “When you throw this kind of big issue in front of an election, people don’t like to have to deal with it,” he said. Bishop, who is term-limited on council, is a running for mayor. He wore the role of council member in Monday’s pension forum that featured Keane, Brown’s Chief of Staff Chris Hand and former council President Matt Carlucci. Carlucci and businessman Charlie Appleby worked on a proposal calling for the city and JEA to each borrow $120 million that, when combined with $60 million from the fund, would satisfy the needed spending to pay down the plan’s liability. Hand and Carlucci both stood by the funding plan as a solution, while Bishop said that deal would negatively impact the city’s annual budget. Although it’s a good deal for JEA, Bishop said the millions lost in annual payment to the city would hurt overall services. When pressed for an alternate plan, Bishop said a sales tax rather than a property tax was a possibility. Hand and Carlucci didn’t endorse an alternative, instead standing by their idea the JEA plan would work. During the forum, Hand also introduced the Linn legal opinion. Afterward, Bishop said he doesn’t know whether waiving the rights would be enforceable in court. The CBRE Inc. real estate company has listed the building’s 150,000 square feet of office space for sublease. The building includes a fitness center and cafeteria. A PHH Mortgage spokesman has not returned calls or emails for comment. The building is managed by Lingerfelt CommonWealth Partners, which manages a large portfolio of properties in Jacksonville Dan Santinga, Jacksonville director of leasing for Lingerfelt CommonWealth Partners, said he could confirm that PHH Mortgage is planning to downsize to 80,000 to 100,000 square feet “and actively exploring various options,” including remaining within the three-story building. The PHH lease expires Nov. 30, 2016. If PHH Mortgage moves, it would have options within Lingerfelt CommonWealth’s many properties. Lingerfelt CommonWealth leases and manages the former Liberty Property Trust office and industrial space in Jacksonville, a 2.1 million-square-foot portfolio of office, flexible-use and industrial space, including 32 Southside buildings. The PHH Mortgage building is part of that. In October, Lingerfelt CommonWealth Partners bought the 28-story Riverplace Tower on the Downtown Southbank. Meanwhile, PHH Mortgage is advertising for jobs. The company plans a “Career Open House” at the Gate Parkway building from 4-8 p.m. Feb. 3 for mortgage sales consultants, loan processors, underwriters, closers, business support representatives, originations supervisors and more. In 2013, New Jersey-based PHH cut a third of its Jacksonville workforce, notifying the state it would lay off 365 positions in Jacksonville, leaving it with about Dilbert 700 local employees. It’s unclear how many employees it now has in the area. Opening the entire building for sublease raises the question whether Deutsche Bank, which continues to expand in Southside, might be a prospect. Deutsche Bank leases the entire five-building Meridian Business Park at 5022 Deerwood Park Blvd., near the PHH Mortgage building. The global financial services company also leases space from Lingerfelt CommonWealth in the Butler Plaza campus nearby along Belfort Road. Real estate observers are waiting for Deutsche Bank’s decision whether to develop an office campus. A site long speculated to be of interest is property near the PHH Mortgage building. Deutsche Bank declined comment. $4.6M Ecolab building nearing construction Plans proceed for the Ecolab Inc. office-warehouse in North Jacksonville. The city is reviewing the building-permit application for the almost $4.6 million project to build the shell warehouse, identified on plans as “Tract 4 – Jacksonville International Tradeport.” The 126,948-square-foot warehouse will be built on almost 9.5 acres at 13500 Tradeport Circle E. The property owner is Thackeray Partners of Dallas. Richard C. Haskew is the contractor. Jarzyna & Associates of Amelia Island is the architect. Ecolab, a St. Paul, Minn.-based company, proposes to lease a build-to-suit facility in the Tradeport Industrial Park for its Microtek Medical division. Previous site plans showed the building will comprise 10,000 square feet for offices and 116,948 square feet for warehouse space. Interior build-out would be permitted separately. Ecolab and the landlord committed to a $9 million investment at the site in the Jacksonville International Airport Community Redevelopment Area. City Council adopted a resolution for Ecolab to receive $214,000 in tax breaks to add 35 jobs in moving to the Tradeport site from Southside. Ecolab committed to a private capital investment of $1.5 million, with a landlord private capital investment of $7.5 million for construction. Ecolab is a water, hygiene and energy technologies and services company. Microtek Medical, its medical device health care division, in 2007 and has been operating in an 88,000-square-foot facility on A.C. Skinner Parkway. It employs 55 people there. Charter school planned in Flagler Center The city is reviewing plans for a Renaissance Charter School in Flagler Center. It would be the seventh in the area. Plans show developer Red Apple at Deerfield LLC of Fort Lauderdale will develop the twostory school on almost 11 acres a along Flagler Boulevard. It would include a basketball court, recreation field and tot lot. The area schools are governed by Renaissance Charter School Inc. and are members of the Charter Schools USA family of schools. Developer Gabe Bove, owner of the award-winning 5 Thousand Town at the St. Johns Town Center, built plenty of wow factors into his mid-rise apartment: A luxury pool, fitness center, dog park, pet spa, music cafe and cardetailing station. But the amenity that sets his complex apart the most, he said, is the rooftop lounge with its soft seating, speakers and dual fire pits. It doesn’t have to be massive, but it should be pleasant and equipped with everything residents need. Cardio equipment and dumbbells are a given, but some gyms have yoga rooms and spinning class rooms. The Uptown at St. Johns Apartments offers these with a split-level layout. Elaborate Vegas-style pools also are huge now. “It’s especially true here in Florida, where on the weekends, everybody spends the biggest portion of their time in and around the pool,” Moulder said. One example is the Cabana Club at Baymeadows Road and Interstate 295, where a winding palm-landscaped pool features a water spray at one end and a lap pool at the other. It’s not just millennials who are heading to apartments in droves, but baby boomers and seniors looking to escape the burden of a house. There are more generations in apartments today and they are staying longer. Leases used to see heavy turnover after a year, with virtually no tenant staying past two years. Now tenants are staying in apartments three, four and five years. “The American dream has shifted a little bit,” Moulder said. “I don’t think owning a home is at the top of the list anymore. People don’t want to make that sort of long-term commitment anymore.” Apartments are filling the gap with great amenities that offer a sense of community, he said.
